Brother Bigger Rewards Promotion - Terms and Conditions

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. Entry is only open to eligible entrants, being businesses that operate in Australia, that are authorised resellers of Brother products and are invited by the Promoter to participate via the receiving of a promotional code (“Eligible Businesses”).

  3. Promotion commences 21/11/2011 and closes 11:59pm AEDST on 31/03/2012 (“Promotional Period”).

  4. To participate, an authorised representative of the Eligible Business must, during the Promotional Period, visit www.brotherbiggerrewards.com.au and register the Eligible Business’ participation in the promotion. To register, the authorised representative must, during the Promotional Period, follow the prompts to create a promotional account for the Eligible Business and provide the requested details, including business name, ABN, contact name, phone number and email address, and the promotional code.

  5. Once the Eligible Business is registered, it will be eligible to earn entries into the promotional draws. To earn entries, registered Eligible Businesses must, during the Promotional Period, sell Brother business machines and consumables (“Products”), and provide a sales report to the Promoter outlining their sales. Reports must be provided at the end of each week during the Promotional Period.

  6. The Promoter reserves the right, at any time, to verify the validity of sales and Eligible Businesses and to disqualify any Eligible Business that tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  7. For every $500 (excluding GST) of Products sold during the Promotional Period, the Eligible Business will earn one (1) entry into the relevant draws, as outlined below.

  8. There will be eight (8) fortnightly draws and one (1) major draw conducted for this promotion. Entries close for each draw at 11:59pm on the dates specified in the table below. For clarity, each entry accumulated by an Eligible Business before the close date of a particular draw will be entered into that draw. Each fortnight during the Promotional Period, registered Eligible Businesses will receive an email from the Promoter notifying them of how many entries they have accumulated into each draw. All draws will take place at Message Media Interactive, Level 22, 385 Bourke Street Melbourne VIC 3000 at 2pm on the dates specified in the table below. All times indicated are in AEST/AEDST unless specified otherwise. Un-drawn entries in each draw will be entered into any subsequent draws and all entries (including winners in a fortnightly draw) will be entered into the major draw. Only one (1) fortnightly draw prize permitted per Eligible Business (excluding Eligible Businesses based in SA). Winners will be notified in writing within two (2) business days of the relevant draw and winners of prizes valued at over $250 will have their names published in The Australian on the dates specified in the table below.

  9. The Promoter’s decision is final and no correspondence will be entered into.

  10. The first five (5) valid entries drawn in Draw 1 will each win a Panasonic Digital Camera (DMC-FH27GN) valued at $329.

  11. The first two (2) valid entry drawn in Draw 2 will win a Samsung 55” LED 3D TV (UA55D8000) valued at $4,699.

  12. The first three (3) valid entries drawn in Draw 3 will each win a pair of Saxon 9/32 Waterproof Binoculars valued at $149.

  13. The first five (5) valid entries drawn in Draw 4 will each win a Sony 10.2” Digital Photo Frame (DPFVR100) valued at $299.

  14. The first five (5) valid entries drawn in Draw 5 will each win 2 x $75 Gold Class Movie Gift Cards for Event Cinemas valued at $150.

  15. The first three (3) valid entries drawn in Draw 6 will each win a Star Shots Perfection Gift Card valued at $405.

  16. The first two (2) valid entries drawn in Draw 7 will each win an Olympus TG-310 digital camera valued at $249.95.

  17. The first two (2) valid entries drawn in Draw 8 will each win a $200 Ticketek Gift Voucher.

  18. Any ancillary costs associated with redeeming any gift voucher or movie ticket are not included. Any unused balance of any gift voucher or movie ticket will not be awarded as cash. Redemption of any gift voucher or movie ticket is subject to any terms and conditions of the issuer including those specified on the gift voucher or movie ticket.

  19. The first valid entry drawn in the major draw will win a trip for two (2) people on board an Orion Expedition Cruise valued at up to $15,600 depending on point of departure. Major prize includes five (5) nights twin share accommodation in the Owner’s Suite, all meals provide on board, access to ship sporting equipment and facilities, all port and handling charges, and $1,500 spending money. The cruise departs Thursday Island, Torres Strait on 27/09/2012 and returns to Cairns, QLD on 02/10/2012. If the prize taker does not reside near Thursday Island, the major prize also includes economy airfares from the prize taker’s nearest capital city to Thursday Island, including airport and airline taxes. Further, if the prize taker does not reside near Cairns, QLD, the major prize also includes economy airfares from Cairns, QLD to the prize taker’s nearest capital city, including airport and airline taxes. If the prize taker resides near either the departure or return point of the cruise, then the major prize does not include airfares to/from these points (as applicable) and those components will not be redeemable for cash. Additional spending money, additional meals, insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Major prize must be taken between 27/09/2012 and 02/10/2012 and is subject to booking and flight availability.

  20. During the entire duration of the major prize, a nominated parent/guardian must accompany any person under 18 years of age.

  21. The prize taker and their companion must depart from and return to the same departure point and travel together.

  22. Itinerary to be determined by the Promoter in its absolute discretion.

  23. Frequent flyer points will not form part of the prize.

  24. Major prize is subject to the standard terms and conditions of individual prize and service providers.

  25. If for any reason the prize taker does not take the major prize (or an element of the major prize) at the time stipulated by the Promoter, then the major prize (or that element of the major prize) will be forfeited.

  26. All prizes will be awarded to the dealer principal of the respective winning Eligible Business who may, in their absolute discretion, allocate the prize to any employee of that Eligible Business.

  27. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  28. Total prize pool value is up to $31,449.90. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

  29. A draw for any unclaimed prizes may take place on 10/07/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners will be notified in writing within two (2) business days of the draw and their names (for prizes over $250) will be published in The Australian on 17/07/2012.

  30. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Business; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  31. Any cost associated with accessing the promotional website is the Eligible Business’ responsibility and is dependent on the Internet service provider used.

  32. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Business to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Business invalid.

  33. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  34. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an Eligible Business; or (f) a prize.

  35. As a condition of accepting any prize, an authorised representative of the Eligible Business must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  36. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
